Paycheck rules in Georgia
What Georgia law says about how much, how and when you are paid. Each rule links to the official source. Checked Oct 25, 2026.
| Topic | The rule | Official source |
|---|---|---|
| Minimum wage | Georgia's own minimum wage is $5.15 an hour, but most workers are covered by federal law and must get at least the federal $7.25 an hour. The state rate only applies to employers of 6 or more not covered by federal law. | Georgia Department of Labor, Minimum Wage |
| Tipped workers | Georgia's minimum wage law does not cover tipped employees, so federal rules apply: a cash wage of at least $2.13 an hour, with tips making up the rest of the $7.25 minimum. | US DOL, Minimum Wages for Tipped Employees |
| Overtime | Georgia has no state overtime law. Federal law applies: 1.5 times your regular rate for hours over 40 in a workweek, enforced by the US Labor Department's Wage and Hour Division. | Georgia Department of Labor, Employment Issues |
| How often you get paid | Georgia requires employers to pay wages at least twice a month (semi-monthly), according to the US Department of Labor's table of state payday rules. | US DOL, State Payday Requirements |
| Final paycheck | Georgia sets no deadline for a final paycheck. Federal law does not require your employer to pay you immediately when you leave; expect it on the next regular payday. | US DOL, Last Paycheck |
| Pay stub | Georgia has no pay stub law, and federal law does not require one either, though your employer must keep accurate pay records. | US DOL, elaws FLSA FAQ |
| Deductions (federal rule) | Under federal law, your employer cannot make you pay for uniforms, tools or cash shortages if that would take your pay below the minimum wage or cut into overtime pay, even if a loss was your fault. | US Department of Labor, Fact Sheet #16: Deductions From Wages |
| Unpaid wage claims | The Georgia Department of Labor does not handle unpaid wage claims. Minimum wage and overtime complaints go to the US Department of Labor's Wage and Hour Division. | Georgia Department of Labor, Employment Issues |
| State withholding form | To have Georgia income tax withheld correctly, fill out Form G-4 and give it to your employer, not to the state. | Georgia Department of Revenue, Form G-4 |
