Paycheck rules in Florida
What Florida law says about how much, how and when you are paid. Each rule links to the official source. Checked Oct 25, 2026.
| Topic | The rule | Official source |
|---|---|---|
| Minimum wage | Florida's minimum wage reached $15.00 an hour on September 30, 2026, the last step of the $1-a-year schedule in the state constitution. From 2027 it will be adjusted each year for inflation. | Florida House of Representatives, CS/HB 221 (2026) staff analysis |
| Tipped employees | Employers can count only $3.02 an hour of your tips toward the minimum wage. With the $15.00 rate, that means a cash wage of at least $11.98 an hour from September 30, 2026. | US Department of Labor, Minimum Wages for Tipped Employees |
| Overtime (federal rule) | Overtime follows the federal rule: non-exempt workers get at least time and a half for hours over 40 in a workweek. Federal law does not require overtime for weekends, holidays or long single days. | US Department of Labor, Fact Sheet #23: Overtime Pay Requirements of the FLSA |
| How often you must be paid | Florida has no state law on how often you must be paid. Your pay schedule is set by your employer, and federal law still requires your wages for each workweek to be paid on the regular payday. | US Department of Labor, State Payday Requirements |
| Final paycheck (federal rule) | Federal law does not require your final paycheck right away. If the regular payday for your last pay period passes and you have not been paid, contact the US Department of Labor's Wage and Hour Division or your state labor department. | US Department of Labor, Last Paycheck |
| Pay stub (federal rule) | Federal law does not require pay stubs, but your employer must keep accurate records of your hours and pay. Ask Florida's labor department whether a state pay stub rule applies to your job. | US Department of Labor, Pay stubs (FLSA FAQ) |
| Deductions (federal rule) | Under federal law, your employer cannot make you pay for uniforms, tools or cash shortages if that would take your pay below the minimum wage or cut into overtime pay, even if a loss was your fault. | US Department of Labor, Fact Sheet #16: Deductions From Wages |
| Unpaid minimum wage claim | Florida has no state agency that takes wage claims. To sue for unpaid minimum wage, first send your employer a written notice with the dates, hours and amount owed; they then have 15 days to pay. | Florida Statutes, s. 448.110 (Online Sunshine) |
| Protection from retaliation | Your employer cannot punish, fire or take other action against you for asking about, complaining about or claiming your minimum wage rights, or for helping a co-worker do so. | Florida Statutes, s. 448.110 (Online Sunshine) |
